      They’re determined at the moment of fertilization when the sperm and the egg combine their DNA to create a new set of DNA. Then, at the moment of conception, you either have Two X chromosomes or One Y Chromosome (like the subreddits) and you get a male or a female 99.95-99.99% of the time if the pregnancy makes it to term.

      It’s like the subreddits. Two X Chromosomes for women, One Y Chromosome for a man. There’s exceptions but it’s an extreme rarity so to make the federal rule “What do your Chromosomes say” is an achievable and consistent standard the vast overwhelming majority of the time.

        Irrelevant. The male sex isn’t physically/biologically represented until hormones start being produced well after conception. To argue this fact would be to admit that a fetus that physically represents a female by all possible physical traits can absolutely still be male if that’s what they feel like.

          I mean, it’s represented in the DNA by having the one or two X chromosomes. You could grab some zygotic DNA and run a PCR test and see which it’s going to be before it ever stops being a blob of cells.

          Your logic is totally broken. “What they feel like” is completely different than an actual genetic marker which can be measured and quantified. This DNA has this, This other DNA has that. Feelings have nothing to do with it. The legal definition becomes about a quite simple PCR test, rather than the fuzzy world of infant development or the fuzzier world of gender identity.

          As I’ve already mentioned, this test won’t be correct in a small number of cases, but as a general rule it’ll be correct 99.95-99.99% of the time which is good enough for government work.

    Non-violent trans inmates, or trans inmates that have been well-behaved inmates, will likely be sent to prisons who do not have much in terms of violence/rape problems…

    And those who were violent criminals who committed serious offense that merit being deposited in the worst prisons?

    Well, part of the punishment for such a crime is living in a place with others like you.

    I don’t wish violence upon anyone, but murderers and rapists being isolated with one another is not something I lose sleep over.

      Yep. There should be tiers to the prison system. Better than they have right now. Violence, murderers tier 1. Rape/sexual predator tier 2. Tier 3 non violent crimes.

      Each tier in its own prison, segregated from each tier.
